Before you light a fire in your garden or plot , be sure to read this article. You will avoid many unpleasantness and fines. The burning of leaves, branches and other waste after gardening is strictly prohibited. If we want to bake a sausage, we canlight a fire in the gardenbut only using appropriate wood and meeting the requirements set out in the recipes. Massacre? Not so scary a devil. Fires in gardens are usually lit for two reasons:

  1. toburn green waste from the plot , dry leaves and trimmed branches, especially those affected by diseases and pests that are not suitable for composting
  2. for recreational purposes, to warm up by a fire or to bake a sausage
  3. We must discuss these two cases separately.

    In the first case, the matter is quite clear -garden waste, such as dry leaves, mowed grass or cut branches, must not be incinerated on the plotEven if it is parts of plants infested by diseases and pests. We are all obliged to segregate waste and hand it over in accordance with the rules prevailing in a given municipality. Usually, green waste has to be delivered to the PSZOK (Selective Waste Collection Point) or put packed in bags on dates specified by the commune (this is how often autumn collections of fallen leaves are organized in the fall).

    The above issue is regulated by the Waste Act of December 14, 2012 , which allows for the incineration of collected plant residues, provided that they are not subject to the obligation of separate collection. Until a few years ago, segregation of garbage was not common and only some municipalities prohibited the incineration of plant residues. Currently, however,the obligation to segregate waste is in force throughout Poland, and thus, no municipality may burn green waste from the garden by itself
    No incineration of residues plants, regardless of whether it is our private plot, a backyard garden or a plot within the RODIn the case of allotment gardens, the burning of green mass is also prohibited by the ROD regulation itself, which in § 68, point 5 prohibits the incineration of any waste and plant residues in the area of ​​the ROD.

    On our own property, however, we are allowed to light a fire in the cells, let's call it "recreational", that is, for example, to bake a sausageBut in such a fire, we are also not allowed to burn waste from the garden. The leaves are not suitable because they give off too much smoke (we will develop the thread of nuisance caused by smoke in a moment) but the branches should not be burned either. The ones left over from pruning are waste and should be disposed of as described above.In the fire, we should only burn properly prepared firewood(preferably with a humidity of 20-30%), which will emit a minimum amount of smoke and pollutants into the atmosphere.

    When designating a place for a fire, we must also take into account fire regulationsThis issue is regulated by the ordinance of the Minister of Interior and Administration of June 7, 2010.on fire protection of buildings, other structures and areas (Journal of Laws No. 109, item 719). According to these regulationsa fire in the garden or on the plot will be illegalwhen:

    • is lit at a distance of less than 100 m from the forest border (§40 section 1),
    • is located in a place where flammable materials can catch fire (§4 section 1 point 5),
    • is lit at a distance of less than 4 m from the border of the neighboring plot (§4 section 1 point 6),
    • is located less than 10 m from the threshing site and places where flammable crops occur (§41 (3)).

    When we are sure that we will not break any of the above-mentioned regulations, we still have to remember about the smoke. Well,smoke from our bonfire cannot get onto the road, where it could limit the visibility and create a hazard in car traffic , and it should not cause a nuisance to the neighbors.
    The last issue is regulated by Art. 144 of the Civil Code, ordering to refrain from actions that would interfere with the use of neighboring properties above the average measure resulting from the socio-economic destination of the property and local relations.
