When designing plantings in real estate or in urban areas, we must always take into account the presence of adjacent buildings and technical infrastructure - above-ground and underground. Accordingly, regulations have been developed regardingthe distance to plant trees from the buildingwithin the property or infrastructure. However, there are no specific regulations that regulate the recommendeddistance for planting trees from the plot border

At what distance from the plot border can fruit trees be planted?

Recommendedthe planting distance of fruit trees from the border of the ROD plot is 2 meters , and planted fruit trees should be poorly growing or dwarfed. In the case of apricots, a distance of at least 3 meters should be maintained, and cherry and walnut must not be planted at a distance of less than 5 meters from the border of the plot, except for varieties grafted on low-growing ties, which can be planted at a distance of not less than 3 meters.
The ROD regulation recommendsto plant fruit bushes at a distance of not less than 1 m from the plot border , and hazel bushes at a distance of 3 meters.

At what distance from the plot border can ornamental trees be planted?

The distance of planting ornamental trees from the border of the RODplot, including deciduous and coniferous trees, should be at least 2 m, provided that they are varieties and poorly growing forms.It is allowed to plant ornamental trees at a distance of 1 meter from the plot border, provided that the height of the plant does not exceed 2 meters. At a distance of 2 m from the plot border, the height of ornamental trees and shrubs should not exceed 3 m.
At the same time, we are obliged to cut and X-ray trees and fruit and ornamental shrubs, so thatthat the branches do not exceed the plot boundariesIf we do not do this, the neighbor may cut off the passing branches, provided that he has previously set a suitable date for them removal and we did not respond to it.

Note!It is worth keeping appropriate distances for planting fruit trees from the plot border, because the fruit that has fallen from a tree or shrub onto our neighbor's land is his property. This is stated in Art. 148 of the Civil Code (Journal of Laws of 1964, No. 16, item 93, as amended).

How far from a building or infrastructure can trees be planted?

In connection with the above, certainminimum distances between planted plants and specific objects .
Permissibleminimum distances for planting trees from the elements of technical infrastructureare:

  • 2 m from water, sewage, gas pipes, heat networks, underground power and communication cables
  • 3 m from the drainage drain
  • 7.5 m plus mature tree crown radius - from 220-750 kV overhead power line
  • 4 m plus tree crown radius - from 30-220 kV power line

Minimumdistances for planting trees from the buildingare:

  • 5 m from a building over 7 m high
  • 4 m from a building less than 7 m high

The distance between planting trees and fenceswith a height of 2 m should be 4 m, and from retaining walls, terraces and steep slopes - 1 m.
