1.1. The organizer of the competition "Win gladioli bulbs with the magazine" My Beautiful Garden ", hereinafter referred to as the Competition, is:
Burda Media Polska Sp. z o.o. with headquarters at ul. Marynarska 15, 02-674 Warsaw, entered into the Register of Entrepreneurs kept by the District Court for the Capital City of Warsaw, XIII Commercial Division of the National Court Register, under the KRS number: 0000574730, NIP: 897-14-11-483, REGON: 931051710 (hereinafter: Burda or Organizer).
1.2. The competition is organized on the terms set out in these regulations (hereinafter referred to as the Regulations) and in accordance with generally applicable law.
1.3. The competition will be organized (played) in the Republic of Poland.
2.1. Participation in the Competition is open to all adult natural persons with full legal capacity who meet the conditions set out in these Regulations (except for the persons mentioned in point 2.2. Below), who will submit their application by March 20, 2019, by 23.59, referred to in point 4.1.
2.2. Competition participants cannot be:
2.2.1. Employees or members of the Management Board of the Organizer and Partner and the closest family members of these people;
2.2.2. People who in any way participated in the preparation and conduct of the Competition, including members of the Jury selecting the winners.
3.1. The competition starts on March 14, 2019 and runs until March 21, 2019.
3.2. The competition will be adjudicated no later than March 22, 2019.
4.1. To take part in the Competition, you must be a registered and logged in Facebook user.
4.2. Participation in the Competition is free.
4.3. By entering the Competition, the Participant accepts the terms of these Regulations.
4.4. The participant declares and warrants that he is en titled to exclusive and unlimited copyrights to the submitted competition work, which is a manifestation of his own individual work of an original nature and is free from physical and legal defects as well as third party claims.
4.5. If the competition task consists in sending the competition entry containing the image of the Competition participant, the Competition Participant declares that he / she gives the Organizer a free consent to record his / her image and disseminate it publicly in the materials relating to the Competition, including as part of the presentation of the competition entry, in particular in the press, TV, promotional and advertising materials, etc.
4.6. In the event that third parties raise claims against the Organizer resulting from violations of the rights referred to in point 4.4, the Participant undertakes to satisfy claims against the Organizer due to these titles. In addition, in the situation referred to above, this person will be disqualified from the Competition.
4.7. The Organizer has the right to exclude this participant from participation in the Competition at any time during the Competition (as well as refuse to grant him a prize), in relation to whom he has learned about actions contrary to the Regulations.
4.8. Incomplete or incorrectly completed Competition applications will not take part in the Competition.
4.9. The competition participant declares that he agrees to multiple (unlimited in number, time and territory) and free use of his competition work (application) in whole and in any selected fragments by the Organizer and companies related to the Organizer by capital or personally, directly or indirectly, as also by entities indicated by the Organizer in all known fields of use, in particular:
a. Fixing and reproducing by printing or similar techniques, including photocopying and microcopying;
b. Publishing (publishing) and disseminating in all editions, regardless of form, standard, system or format, without limitation in the number of copies, editions and copies; this also includes the right to reprint in part or in full (before and after production), including photocopying, microcopying and micro-reproduction, as well as any other reproduction;
c. Entering into computer memory and making copies of such records for the purposes of operation, and permanent or temporary reproduction of the computer record, in whole or in part, by any means and in any form;
d. Use for marketing purposes, including advertising, promotion, marking or identification of the Organizer; it also includes the recording and multiplication by printing and the use of these fixations; audiovisual recording with any technique, regardless of the standard, system and format; broadcasting by wired or wireless vision or sound by any technical means, including broadcasting via satellite; recording on devices for multiple reproduction using sound and image carriers, including duplication, distribution and playback of recordings, transmission, playback and broadcasting in broadcasts in mass media, after recording on sound and / or image carriers;
e. Public sharing in such a way that everyone can have access to it at a place and time chosen by them, including any - electronic, digital, etc. public communication channel;
f. Marketing, dissemination of copies and copies. The competition participant grants the Organizer, on the basis of this provision, a permit to use derivative copyrights in all the fields of exploitation mentioned above, provided that for the exploitation of the above-mentioned competition work in these fields, it is necessary or necessary to create a derivative work, as well as a permit to grant mutual and simultaneous or independent development, modification, adaptation of parts or all, including by giving them various forms (amended, shortened, extended or condensed) with the law for reproduction on recording media (floppy disk, memory card, film, slide, microfilm, photocopying, micro-reproduction, CD and DVD, etc.) and with the right to use on sound and image carriers. The competition participant also grants the Organizer permission to grant further licenses in the scope of acquired rights to the above-mentioned competition entry.
4.10. The competition participant agrees that his competition work submitted by him to the competition shall be used in accordance with the needs of the Organizer and / or the entity indicated by the Organizer and the requirements of its publication and dissemination in the above-mentioned fields of use, subjected to appropriate processing, modifications, adaptation, adding titles and sub titles, abbreviations, technical adjustments, creating studies and corrections, including stylistic, spelling and linguistic corrections, etc.
5.1. From among correctly submitted competition applications, the competition committee will select 3 winners, taking into account in particular the following criteria: originality, curiosity, substantive and stylistic correctness of the submitted competition entry.
5.2. The prizes for the winners of the Competition are: 3 prizes, where each prize is 12 gladioli bulbs. The value of the 1st prize is PLN 21.00 gross.
5.3. There is no cash or material equivalent for the prizes won.
5.4. The laureate may not assign the prize to another person.
5.5. The winner has the right to resign from the won prize. In such a case, the prize becomes the property of the Organizer.
5.6. After the conclusion of the Competition, the Organizer will contact the Competition winners via the social network in which the competition announcement was published via a private message with information about the win and a request to send electronically the indicated personal data necessary to deliver the prize.
5.7. Prizes won in the Competition will be shipped within a week from the end of the Competition and posting its results on FB and on the website www.mojpieknyogrod.pl.
5.8. In the event that the Winner does not meet the conditions described in point 5.6 or fails to collect the prizes by April 25, 2019, the prizes will be forfeited.
5.9. Failure to provide the prize as a result of failure to provide personal data and / or contact details, providing incorrect data or failure to update the data by the Competition winner or failure to provide full data indicated in point 5.6 means the loss of the right to the prize, which prize becomes the property of the next potential winner.
5.10. The condition for receiving the prize is that the prize winner meets all the provisions of these Regulations.
5.11. The list of Competition winners published in an anonymised way (e.g. using the first name and the first letter of the surname or nickname along with the place of residence) may be published in the materials resolving the Competition, in particular on the website where the Competition was published.
6.1. A Committee composed of the representatives of the Organizer will be appointed to control the correctness of the Competition.
6.2. The Committee will supervise the fulfillment by the Organizer of all obligations arising from these Regulations.
7.1. Data processing takes place within the scope specified by the provisions of the Personal Data Protection Act of May 10, 2022-2023, Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of individuals with regard to data processing personal data and on the free movement of such data and the repeal of Directive 95/46 / EC (General Data Protection Regulation) and the Act amending certain acts in connection with ensuring the application of Regulation 2016/679.

7.3. The personal data of the participants of the Competition will be processed for the purposes of conducting the competition, selecting the winner and awarding, issuing and collecting the prize, and settling the complaint procedure. If the Participant expresses a separate relevant consent, he may receive the newsletter by e-mail, commercial offers of the Organizer and its Partners (the list is available at www.burdamedia.pl/partnerzy), the Organizer may contact the Participant for advertising and marketing purposes.

8.1 Complaints related to the Competition will be accepted by the Organizer in writing to the Organiser's address within 14 days from the end of the Competition.
8.2. The Complaints Committee, composed of the representatives of the Organizer, is appointed to resolve the complaint.
8.3. In the case of sending a complaint submitted via post, the date of sending is decisive.
8.4. Complaints submitted by participants will be considered by the Complaints Committee no later than within 14 days from the date of receipt of the complaint.
8.5. Those interested will be notified of the complaint consideration by registered mail sent at the latest within 7 days from the date of considering the complaint by the Complaints Committee.
8.6. The decision of the Complaints Committee as to the submitted complaint is final, which does not exclude the participant's right to pursue unrecognized claims through court proceedings.
9.1. The regulations of this Competition are available on the website www.mojpieknyogrod.pl and at the Organiser's office.
9.2. At the Competition participant's request, the Organizer will send a copy of the Competition regulations after sending a self-addressed stamped envelope.
9.3. By taking part in the Competition, the participant confirms that he agrees to all the rules contained in the Regulations.
9.4. In matters not covered by these regulations, the provisions of the Civil Code, in particular art. 919 - 921 of the Civil Code.
