Building a well is regulated by law. In order to proceed with its implementation, the conditions specified in the water law, as well as mining and geological law must be met. Pursuant to Art. 36. of water rights, the land owner has the right to the so-called ordinary use of the water that is his property and the groundwater on his land, if this serves the needs of one's own household.
A water permit is required for the construction of water devices. A permit for the construction of wells up to 30 m deep for "normal use" is not necessary, provided that the water intake does not exceed 5 m3 per day. If the depth of a well intended for the ordinary use of water does not exceed 30 m, such a well is not subject to geological and mining law - otherwise, the conditions specified in the regulations must be met, e.g. develop a well drilling project and approve it by the voivode.
Regardless of the above, the execution of construction works must be reported to the starost (mayor of the city). The notification must specify the type, scope and manner of performing construction works, the date of their commencement and attach sketches or drawings. The technical conditions for the construction of the well are defined by the provisions of the Ordinance of the Minister of Infrastructure of April 12, 2002 on the technical conditions to be met by buildings and their location (§ 31-33); m.in the distance of the wells should be 5 m from the plot border, 7.5 m from the axis of the roadside ditch and 15 m from the waste collection tanks.
