How to write an application to cut a tree?

Permission for the removal of a tree or shrubin connection with the conducted business activity requires a permit issued by an appropriate authority, such as a city or commune office, poviat office, voivodeship marshal or voivodeship monument conservator .If we want to obtain this permission, we must first submit the appropriateapplication for cutting down the treeHow to do it? Where to start?

Step 1 - Determine which trees are to be cut
First of all, we have to carefullymeasure the circumferences of the trees and determine their speciesThe circumferences are measured at a height of 130 cm from the ground. If the tree has several trunks or is shorter, measure the circumference of each trunk. If, on the other hand, there is no trunk at a height of 130 cm, because it is, for example, a low, spreading tree, we measure the circumference directly below the tree's crown. In the case of shrubs, measure the area they occupy in m² and determine, as in the case of trees, their species.

Step 2 - prepare a plot plan with selected trees for logging
We have specific species, measured trunks, now we are preparing a map or a hand-drawn drawing or a plot development plan, on whichwe mark trees and shrubs and the plot border, buildings and other objectsthat are currently on the plot or which we plan to build.
Step 3 - Prepare the content of the request for tree cutting
We can of course download such an application directly from the office or from the office's website. However, if we do not have this option, you can write the application yourself or download our readypattern of the application for cutting the tree , including information such as:

  • name, surname and address of the property,
  • list of trees and shrubs that we want to cut, their species and trunk circumference,
  • address or parcel number,
  • size of the area from which we want to cut the shrubs,
  • information why we want to remove trees and shrubs, and indicate whether the removal is due to the purpose of running a business,
  • date when we plan to cut down trees and shrubs.

Step 4 - Include the required attachments
After writing the application, we need to prepare additional necessary documents.
We attach to the application for tree cutting:

  • declaration on the legal title to use the real estate (e.g. owner, perpetual usufructuary, tenant) or on the ownership of transmission equipment,
  • declaration of the plot owner that he or she agrees to cut down trees and shrubs - only if we are not the plot owner or perpetual usufructuary,
  • declaration on providing information on the planned logging to residents (this only applies to housing cooperatives and communities). Comments may be submitted by residents for at least 30 days,
  • draft plan of replacement or transplanted plantings - if we plan to do so. In the project, we take into account the number, species or varieties of trees or shrubs, place and date of replacement plantings,
  • decisions and resolutions that have been issued as part of the environmental impact assessment of the project - if we have such documents,
  • permission of the General or Regional Director of Environmental Protection for protected species, for example, for the destruction of protected lichens that grow on trees, or scaring birds during the breeding season - if we have such documents.

Step 5 - Submit your documents and wait for the decision
After preparingof all documents, together with the application for cutting down the tree , we submit them to the appropriate office.
Then we wait for the official's visit.An official will come to our plot within 21 days and verify the information from the application , and then draw up a protocol. He will check the circumferences and condition of the trees, as well as whether there are any protected species or birds in the nests on the tree or shrubs.
Within the next 14 days, the local government will check if there are any contraindications for cutting the plant, e.g.the real estate will be entered in the register of monuments or the area will be designated for greenery in the local development plan. If we do not receive any reply after 14 days, we can assume that we have received permission to cut down the tree.
