REGULATIONS FOR PARTICIPATION IN THE WORKSHOPS

§1 Provisions of the regulations

These regulations define the rules of services provided by Burda Media Polska Sp. z o.o. listed on the website www.mojpieknyogrod.pl/warsztaty. These regulations constitute an integral part of the form for participation in workshops organized as part ofAkademia Ogrodnika perfectlyegoBy filling in and sending the online form (available at https://www.mojpieknyogrod.pl/warsztaty/zapisz-sie ), mark the point confirming that you have read these regulations and accept their content.
Explanation of terms: Organizer - Burda Media Polska Sp. z o.o. based in Warsaw Participant - a natural person over 18 years of age with full legal capacity.Exceptionally, a participant may also be a person over 16 years of age who meets the conditions for participation in §2 point 2 of the Regulations. Ordering Party - the person placing the order (completing the form) who is an adult, with full legal capacity, acting on behalf of himself or on behalf of third parties, as well as: an organizational unit without legal personality or a legal person, party to the contract with the Organizer, ordering participation in the workshop, acting for its own benefit or for the benefit of a third party. Gardening workshops conducted by the lecturer as part ofAkademia Ogrodnika perfectlyego- devoted to the development of the participants' knowledge in the field of gardening; the classes take the form of a lecture combined with practical exercises, and cover the territory of the Republic of Poland. These classes are aimed at people interested in gardening, including beginners.

§2 Conditions for participation in the workshop

1.Placing an order for participation in the workshop is possible only after correctly completing the form on the Organiser's website (https://www.mojpieknyogrod.pl/warsztaty/zapisz-sie), providing all mandatory data contained in the form, registering and accepting the provisions of the regulations.

2. A workshop participant can be any person over 16 years of age, subject to the next sentence. In the case of Participants who are under 18 years of age, a written consent of both parents or legal guardians is required, including a declaration of full responsibility for the minor during the workshop.

3. Payment for participation in the workshop is made by making payments within 7 working days from the date of filling in and sending the registration form, but not later than 7 working days before the start of the workshop at the level indicated in the form.

4. Payments should be made by bank transfer to the following bank account: Raiffeisen Bank Polska: 49 1750 1064 0000 0000 0721 7242 (Burda Media Polska Sp.z o.o., Marynarska 15, 02-674 Warsaw), with the name of the appropriate workshop.

5. The prices for the workshops are contractual prices including tax on goods and services. The prices include only those benefits described for a given workshop - they do not include travel and accommodation costs.

6. At the express request of the Organizer, the Participant receives an invoice for the payments made after the payment of the entire amount due for the workshop (s) being the subject of the contract. The above may, however, take place no later than within 7 days from the date the payment is credited to the account. In this case, the participant is asked to send an appropriate message by e-mail to the following address: [email protected].

7. The organizer has the right to refuse to accept the order if:
- the person interested in participating in the workshop does not meet all the conditions set out in the regulations;
- the person placing the order completed the application form inconsistently with the existing factual or legal status, or omitting the personal data necessary for the provision of the provision of personal data, and these deficiencies have not been removed within the time limit indicated by the Organizer;
- the ordering party being a minor, does not present, at the request of the Organizer, the consent of the parents / legal guardians for his participation in the workshops;
- the ordering party will not prove at the Organiser's request that it has the consent of third parties whose data it used during the order placed;- the ordering party is the Organizer's debtor or caused damage to the Organizer under any legal title or if there are other reasons why the Organizer will not be able to accept the application.

8. The Organizer has the right to withdraw or suspend the Participant's participation in the workshop organized as part ofAcademy of Perfect Gardenerin the event of the Participant taking actions to the detriment of the Organizer or actions inconsistent with the regulations. The decision to withdraw or suspend participation in theAcademy of Excellent Gardenerwill be provided to the Participant in writing with justification.

§3 Workshops and Participant's obligations

1. The participant is en titled to benefits guaranteed by ordering participation in the workshops.

2. Each time the program and the scope of the workshops are posted on the website www.mojpieknyogrod.pl/warsztaty in a way that allows the Participant to get acquainted with it.

3. The participant is obliged to comply with all instructions and recommendations of the Organizer enabling the implementation of the workshop program. The participant is obliged to comply with order regulations and safety recommendations.

4. Serious or frequent breaches of order rules may constitute grounds for excluding the Participant from participation in the workshop.

§4 Canceling / rescheduling the workshop

1. In order to ensure the greatest possible satisfaction for the Participants from participation in the workshops, the Academy of the Perfect Gardener reserves that the number of workshop participants is limited each time.

2. The maximum number of people in a group at one level of the workshop is 10 people. The minimum number of people in one group is 8.

3. If the interest exceeds the number of places planned by the Organizer, the payment date decides about participation in the workshop.

4. The Organizer will notify about the end of recruitment for individual workshops by posting relevant information on the website in the tab dedicated to the selected workshop, and in the case of an attempt to place an order - also to the e-mail address provided by the interested party in the application form.

5. The organizer reserves the right to cancel or change the date of the workshop:

a) 3 days before the start of the workshop at the latest, as the minimum number of participants has not been reached. The Organizer will notify the Participant of its cancellation within the time limit indicated above to the e-mail address provided by the Ordering Party, and in urgent cases also by phone to the telephone number provided by the Ordering Party.

b) Not later than 12 hours before the start of the workshop for reasons beyond the control of the Organizer, in particular due to natural disasters, floods, fires, riots, war, terrorist attacks, strikes, epidemics, lack of means of transport, government orders and regulations, bans on running a business, introducing a state of emergency in the place of the planned workshop, as well as sudden illness of the lecturer that makes it impossible to provide a proper replacement. The Organizer will notify the Participant about the cancellation of the workshop within the time limit indicated above to the address provided by the Ordering Party, as well as by phone to the telephone number provided by the interested party.

6. In the event of cancellation of the workshop, the Organizer shall return to the Participant all fees paid by him within 14 working days from indicating by the Participant the bank account number to which the payment is to be made.

7. The Organizer will inform the Participant about the change of the date of the workshop or a change in other important circumstances without undue delay to the e-mail address provided by the Ordering Party and by phone. The Participant is obliged to immediately inform the Organizer whether he accepts the proposed change or withdraws from the Agreement. In the event of a decision to withdraw from the Agreement, the Organizer shall return to the Participant all fees paid by him within 14 working days from indicating by the Participant the bank account number to which the payment is to be made.

8. If the date of the workshop is changed by the Organizer in the case referred to in point 5 above, the Participant has the right, at his choice:

a) participate in workshops of the same formula - depending on the availability of places - held at the same time or on a different date;

b) demand the return of any amounts paid to the Organizer.

9. If the Participant wishes to resign from participation in the workshop, this fact must be reported by the Participant in writing via e-mail within 7 working days before the course starts. In the event that the Participant resigns within less than 7 working days or if the Participant fails to appear at the workshop, the Organizer has the right to retain the full amount of the collected remuneration.

§ 5 Complaints

1. In the event of any deficiencies in the course of the workshop, the Participant is obliged to immediately inform the Organizer about the observed deficiencies and to demand remedial measures.

2. Regardless of the notification of the deficiencies, the Participant has the right to submit a complaint to the Organizer within 7 working days from the end of the workshop. The complaint should be made in writing and delivered to the address of the Organizer's seat.

3. The complaint must indicate the type of failure and specify the Participant's request. However, the basis for the complaint may not be events and circumstances for which the Organizer is not responsible, i.e. those resulting only from the actions or omissions of the Participant, actions or omissions of third parties for which the Organizer is not responsible, if these actions and omissions cannot be made. could neither foresee nor avoid them and the damage caused by force majeure.

4. Submitting a complaint without meeting the above-mentioned requirements is the basis for refusing to take it into account.

5. The Organizer will consider the complaint within 14 working days from the date of its submission, with the date of receipt of the complaint by the Organizer decisive. Each time, the Organizer will inform the Participant about the method of considering the complaint in writing.

§ 6 Personal data protection

1. Burda Media Polska Sp. z o.o. informs that he is the administrator of personal data of workshop participants.

2. The personal data provided by the Participant has been collected and will be processed in order to implement the contract concluded with Burda Media Polska for participation in the workshops, as well as to undertake the necessary activities related to the organization of the workshops.

3. Providing personal data is completely voluntary, however, the lack of such data on the part of the Organizer prevents the proper provision of the service and may constitute the basis for refusing to accept the order.

4. The Participant has a voluntary option to consent to receive commercial information, including the newsletter, addressed to the Participant by means of electronic communication, in particular e-mail, in accordance with the provisions of art. 10 section 2 of the Act of July 18, 2002 on the provision of electronic services (JournalU. 144 of 2002, item 1204) from Burda Media Polska Sp. z o.o …

5. The participant has a voluntary option to consent to the processing of personal data by Burda Media Polska and entities cooperating with them, for marketing purposes, including sending promotional and information materials, offering products, market and public opinion research, in accordance with the Act of August 29, 1997. . about personal data protection. 6. The Ordering Party and the Participant have the right to inspect the provided data and to correct or change them.

§ 7 Final provisions

These regulations apply to people who place an order from 15/04/2015 until further notice. The current Regulations are available for inspection at the Organiser's office, as well as on the website. Any disputes will be settled amicably by the parties, and in the event of failure to reach an agreement by the competent court. The invalidity of individual provisions of the regulations does not affect the validity of the entire regulations.
